Privacy Policy

The processing of personal data on www.optimalbalance.pl and the data of business partners of Optimal Balance sp. z o.o. is governed by our policy. The policy is divided into two parts:

  • Basic information about the data administrator and your rights as customers – these apply to any process described in Part Two.
  • Details of the processing of your personal data:
    • handling enquiries received by the contact form or by e-mail;
    • performance of contracts between Optimal Balance and your company;
    • cookie policy;
    • processing of server logs.

Basic information

The administrator of your personal data is OPTIMAL BALANCE Sp. z o.o., with its registered office in  Wrocław, (50-062), Pl. Solny 15, National Court Register number 0000583950, Tax number 8971815453. This policy has been prepared by OPTIMAL BALANCE based on the provisions of the General Data Protection Regulation (EU) 2016/679, which is hereinafter referred to as „RODO”.

The exception is the debt collection process on behalf of our clients (point 3 below), where the data administrator in each case is our client. 

OPTIMAL BALANCE has appointed a Data Protection Officer, who can be contacted by biuro@optimalbalance.pl. 

You have the right to: withdraw the consent you have granted at any time, access the content of your data and request rectification, erasure, restrict data processing, data portability and object to the processing of your data.You also have the right to lodge a complaint with the President of the Personal Data Protection Office. 1. Handling of enquiries from the contact form and email

Why does OPTIMAL BALANCE process data?
The personal data you provide is processed for the purpose of contacting and handling your request or enquiry received by e-mail.

Is the provision of data mandatory?
The provision of personal data in the contact form is required by OPTIMAL BALANCE in order to handle your enquiry. Failure to provide the required data will result in an inability to provide you with a response to your enquiry.

What legal basis is your data processed on?
The personal data you provide is processed on the basis of Article 6(1)(b) of the RODO, and to the extent that the provision of data is optional (e.g. in email correspondence), the legal basis for processing is consent, in accordance with Article 6(1)(a) of the RODO. Once you have responded, the legal basis is the legitimate interest of the data administrator (Article 6(1)(f) RODO) to protect against possible claims and to ensure the stability of the IT system.

Whom may your data be transmitted to?
Your personal data is passed on to IT system and IT service providers and to service providers, including legal and insurance services for OPTIMAL BALANCE. With regards to the Captcha mechanism to protect against robots and to protect the website – your cookie ID is transferred to Google LLC.

How long will OPTIMAL BALANCE store your data?
Your personal data will be stored until you have answered the question provided in the form or sent a full offer, and then for 3 years to protect you against possible claims.

What categories of personal data do OPTIMAL BALANCE process?
This is the data provided to OPTIMAL BALANCE by the contact form and the history of previous contacts.

2. Implementation of contracts

Why does OPTIMAL BALANCE process personal data?
The personal data you provide is processed for the following purposes:

  • Conclusion and execution of the agreement between OPTIMAL BALANCE and the Counterparty, including communication related to the conclusion and execution of the agreement;
  • Fulfilment of regulatory obligations, among others, the need to issue documents such as VAT invoices;
  • Establishing, pursuing or defending against claims.

Is the provision of personal data mandatory?
The provision of data is necessary for the conclusion and performance of the contract or for the cooperation between OPTIMAL BALANCE and the Contractor.
On what legal basis is your personal data processed?
The personal data provided is processed on the basis of:

  • the legitimate interest of the administrator (Article 6(1)(f) of the Data Processing Agreement) consisting in the conclusion and performance of the contract between OPTIMAL BALANCE and the Contractor, and if the Contractor is you, then Article 6(1)(b) of the Data Processing Agreement applies;
  • fulfilment of a legal obligation (Article 6(1)(c) RODO);
  • the legitimate interest of the controller (Article 6(1)(f) RODO) to establish, assert and defend against claims.

To whom may your data be passed on?
Your personal data is passed on to IT system and service providers and to entities providing services to OPTIMAL BALANCE, including legal services, insurance, auditing and postal services.
How long will OPTIMAL BALANCE process your data?
Personal data will be stored:

  • with regards to the conclusion and execution of the agreement between OPTIMAL BALANCE and the Contracting Party – until an objection has been lodged and successfully dealt with;
  • with regards to the fulfilment of a legal obligation, 5 years from the end of a calendar year, starting from the following year in which the event giving rise to the legal obligation occurred;
  • with regard to the establishment and assertion of claims, until the expiry of the limitation period for claims, not exceeding 6 years from the end of the calendar year following the year in which the event giving rise to the claim occurred.

What categories of personal data does OPTIMAL BALANCE process?
These are business data: email address, telephone, name, position, contact history.
Where does OPTIMAL BALANCE obtain personal data from?
OPTIMAL BALANCE has received your data because you are a representative of, are acting on behalf of, or are acting on behalf of a counterparty with whom OPTIMAL BALANCE has entered into or is negotiating an Agreement, and the personal data OPTIMAL BALANCE has received from you has been provided by the aforementioned counterparty or has been collected from publicly available records (e.g., data of people representing the Counterparty indicated in the body of the Agreement).

3. Implementation of recovery processes

Why does OPTIMAL BALANCE process data?
The personal data you provide is processed for the purpose of fulfilling contracts with clients for debt collection services.
What legal basis is your data processed on?
It is the customer who exactly determines the legal basis for the processing, most often the personal data provided is processed on the basis of the contract you have concluded with our customer (creditor).
Whom may your data be passed to?
Your personal data is passed on to providers of IT systems and services and to providers of services to OPTIMAL BALANCE, including legal, insurance services.
How long will OPTIMAL BALANCE process your data?
Personal data will be stored in accordance with the contract concluded with our client, most often until the collection process is completed and the claims are then time-barred, no longer than 6 years from the end of the calendar year counting from the following year in which the event giving rise to the claim occurred.
Where does OPTIMAL BALANCE obtain personal data from?
OPTIMAL BALANCE receives your data from the customer.

4.Processing of cookies (Cookie Policy)

The Website uses cookies. Cookies are IT data, in particular text files, which are stored in the Service User’s terminal equipment and are intended for use on the Website.
For what purpose does OPTIMAL BALANCE process data?
Cookies are used for the following purposes:

  • tto compile statistics which help to understand how visitors to the Website use the pages, so that we can improve their structure and content (analytical purpose);
  • maintaining a session of the Service User (after logging in), thanks to which the User does not have to re-enter his/her login and password on each sub-page of the Service; (functional purpose);
  • to define your profile in order to display tailored material to you on advertising networks, in particular the Google network; (advertising purpose).

Is the provision of data mandatory?
The use of cookies is voluntary. Restricting the use of cookies may affect certain functions available on the website.
On what legal basis is your data processed?

  • With regards to cookies used for analytical and advertising purposes – the personal data provided will be processed on the basis of Article 6(1)(a) of the RODO, i.e. on the basis of your consent given in accordance with Article 173 of the Telecommunications Act.
  • With regards to cookies used for functional purposes – the personal data provided will be processed on the basis of Article 6(1)(f) of the RODO, i.e. on the basis of the Administrator’s legitimate interest in providing you with the appropriate quality of service and functionality of the website.

To whom may your data be passed on?
Cookies are placed on a Service User’s terminal equipment and may also be used by advertisers and partners cooperating with the Service Operator. Cookies may be used by advertising networks, in particular Google, Facebook and OpenX to display advertisements tailored to the manner in which a user uses the Service. For this purpose, they may retain information about the user’s navigation path or the time spent on a particular page.
How long will OPTIMAL BALANCE process your data?
The Website uses two main types of cookies: „session” (session cookies) and „permanent” (persistent cookies). „Session” cookies are temporary files that are stored on the User’s terminal equipment until they log off, leave the website or switch off the software (web browser). „Persistent” cookies are stored on the User’s terminal equipment for the time specified in the parameters of the cookies or until they are deleted by the User.
What categories of personal data does OPTIMAL BALANCE process?

Where does OPTIMAL BALANCE get its cookie data from?
Directly from you. Your web browsing software (internet browser) may allow cookies to be stored on your terminal device by default. The User of the Website can always change their settings in this respect. Your Internet browser also allows you to delete cookies, as well as to automatically block cookies For details, please refer to the help or documentation of your Internet browser.

5. Processing of server logs

Is the provision of data mandatory?
The provision of data related to server logs is mandatory, it is a contractual requirement, and the refusal to provide it means that the data cannot be processed and the requested service cannot be provided.
On what legal basis is your data processed?
The personal data provided will be processed on the basis of Article 6(1)(b) of the RODO, i.e. on the basis that it is necessary to provide it in order to fulfil the user’s request.
To whom may your data be passed on?
Your personal data is passed on to providers of IT systems and services and to providers of services to OPTIMAL BALANCE.
How long will OPTIMAL BALANCE process your data?
Personal data is stored up to a year from saving information on the server.
What categories of personal data does OPTIMAL BALANCE process?
The resources viewed are identified by URLs. In addition, the record may be subject to:

  • the timing of the enquiry;
  • time of sending the reply;
  • the name of the client station – identification via the HTTP protocol;
  • information about errors with the usage of HTTP transactions;
  • the URL of a page previously visited by the user (referrer link), in the event of a link to the Website;
  • information about the user’s browser;
  • IP address information.

The above data is not associated with specific people browsing the OPTIMAL BALANCE website.
Where OPTIMAL BALANCE get the personal data from?
OPTIMAL BALANCE receives log data directly from your device.

Policy changes

We want to ensure that the Privacy Policy complies at all times with current legal requirements, new guidelines from data protection authorities and reflects Optimal Balance’s current data processing processes. New technologies and data processing requirements may also change. This means that we may, and sometimes will have to, make modifications to the Privacy Policy in the future. If we introduce new services or change the services we currently provide, we will also update this Policy.
